为了加快重庆国际商事仲裁中心建设，提高重庆国际仲裁案件的服务能力和办理质效，根据《中华人民共和国仲裁法》《重庆仲裁委员会章程》的规定，本会决定面向国内外公开聘用一批国际商事仲裁员。现将有关事项公告如下：

To accelerate the construction of Chongqing International Commercial Arbitration Center, and improve the services and efficiency of Chongqing international arbitration cases, in accordance with the provisions of the Arbitration Law of the People’s Republic of China (hereinafter referred to as “Arbitration Law”) and the Articles of Association of Chongqing Arbitration Commission (hereinafter referred to as “Articles of Association”), the Commission decided to recruit a group of international commercial arbitrators in China and abroad, with relevant issues announced as follows:

一、申请条件

申请人除应符合《中华人民共和国仲裁法》第十三条规定的条件外，还应满足下列条件：

（一）基本条件

1.遵守《重庆仲裁委员会章程》《重庆仲裁委员会仲裁规则》《重庆仲裁委员会仲裁员管理办法》等有关规定；

2.公道正派、诚实守信、勤勉高效；

3.能够运用信息化系统和应用程序；

4.至少熟练掌握一门外语，能够运用双语进行庭审，具有丰富的办理国际民商事案件经验；

5.具有较强的语言表达、文字写作能力；

6.能够保证从事仲裁工作的时间；

7.身体健康，年龄不满65周岁，长期办理国际商事案件，经验丰富且办案效果好的，年龄可放宽。

I. Application conditions

The applicants shall meet the terms in Article 13 of the Arbitration Law, and also meet the following conditions:

1. Basic conditions

1.1 Abide by the Articles of Association, Arbitration Rules of Chongqing Arbitration Commission, Administrative Measures for the Arbitrators of Chongqing Arbitration Commission;

1.2 Be fair and decent, honest and trustworthy, diligent and efficient;

1.3 Be skilled in using information systems and apps;

1.4 Be proficient in at least one foreign language, be able to conduct bilingual court hearings, and have rich experience in handling international civil and commercial cases;

1.5 Be good at language expression and text writing;

1.6 Ensure enough time to engage in arbitration work;

1.7 Have good physical conditions, under the age of 65 (age limit for applicants with rich experience and excellent performance in handling international commercial cases can be relaxed).

（二）针对不同国籍、职业、专业领域的申请人，还应同时满足下列条件：

1.中国籍申请人

＞＞＞法律教学、研究工作者

①具有教授、研究员高级职称，或者具有副教授、副研究员高级职称五年以上并获得博士学位；

②直接从事国际民商事法律教学、研究工作;

③具有丰富的国际商事仲裁案件办理经验。

＞＞＞专职律师

①执业10年以上，具有法律专业硕士研究生以上学历；

②从事或者曾从事涉外诉讼或国际商事仲裁业务，具有丰富的国际商事办案经验；

③在律师行业中具有较高的国际商事法律水准和良好信誉。

＞＞＞符合以下条件的申请人在同等条件下优先考虑

①具有国家承认学历的境外大学法律教育背景或者能够提供具有较高外语水平的相关证明，能够用外语进行庭审；

②具有境外国家或者地区律师等执业资格；

③具有“一带一路”及西部陆海新通道沿线、东盟国家的投资及经贸往来实务及理论研究经验。

＞＞＞中国香港、澳门特区和台湾地区申请人

①拥护“一国两制”基本国策，爱国守法，支持国家统一。

②具有丰富的国际商事仲裁实践经验，且符合上述第（一）条基本条件的规定。

③符合以下条件的申请人在同等条件下优先考虑

· 具有境外国家或者地区律师等执业资格；

· 系境内外知名仲裁机构在册仲裁员。

2.外国籍或者无国籍申请人

①相关资格参考《中华人民共和国仲裁法》规定的仲裁员资格条件，具备国际仲裁与争议解决实务经验，在所在国家或者地区以及所在行业，享有较高专业声誉。

②符合以下条件的申请人在同等条件下优先考虑

· 具有境外国家或者地区律师等执业资格；

· 系境内外知名仲裁机构在册仲裁员；

· 来自“一带一路”、西部陆海新通道沿线、东盟国家且具有丰富的国际商事仲裁或诉讼实务经验。

2. Applicants of different nationalities, occupations and professional fields shall meet the following conditions:

2.1 Chinese applicants 

＞＞＞Applicants engaged in law teaching and research

① Have a senior title of professor or researcher, or have a senior title of associate professor or associate researcher for more than five years and have obtained a doctor’s degree;

② Directly engaged in international civil and commercial law teaching and research;

③ Have rich experience in handling international commercial arbitration cases.

＞＞＞Full-time lawyers

① More than 10 years of practice, with a master’s degree in law;

② Be engaged in or have been engaged in foreign-related litigation or international commercial arbitration business, with rich experience in handling international commercial cases;

③ Be professional in international commercial law and have good reputation in the legal industry.

＞＞＞Applicants meeting the following conditions have priorities under equal conditions:

① Have education background of law major in overseas universities recognized by China, or provide relevant proof of having high level of proficiency in a foreign language, and be able to conduct court hearings with a foreign language;

② Have practicing qualification of lawyers in foreign countries or regions;

③ Have experience in practice and theoretical research in investment and economic & trade exchanges along the countries in the “Belt and Road”, the New International Land-Sea Trade Corridor and ASEAN.

＞＞＞Applicants from Hong Kong, Macao SAR and Taiwan

① Uphold the basic Chinese policy of “one country, two systems”, be patriotic, abide by the Chinese law, and support national reunification of China.

② Have rich practical experience in international commercial arbitration, and meet the basic conditions as stipulated in Article 1 above.

③ Applicants meeting the following conditions have priorities under equal conditions:

· Have practicing qualification of lawyers in foreign countries or regions;

· Be a registered arbitrator of a well-known arbitration institution in China and abroad.

2.2 Foreign or stateless applicants

① Meet the qualifications of arbitrators stipulated in the Arbitration Law, have practical experience in international arbitration and dispute resolution, and have good reputation in their located country/region and the engaged industry.

② Applicants meeting the following conditions have priorities under equal conditions:

· Have practicing qualification of lawyers in foreign countries or regions; 

· Be a registered arbitrator of a well-known arbitration institution in China and abroad;

· Coming from the countries along the “Belt and Road”, the New International Land-Sea Trade Corridor and ASEAN, and have rich experience in practice and theoretical research in investment and economic & trade exchanges.

二、选聘程序

（一）申请。申请人应当填写《重庆仲裁委员会仲裁员申请表》（见附件，或者登陆本会官网www.cqac.org.cn首页“国际仲裁员选聘工作专栏”下载），并按《仲裁员申请材料清单》要求，按时提交申请表及相关材料。

（二）初审。对所有申请材料进行初步审查（包括申请时间、资格条件、资料完善情况等）。

（三）复审。根据择优选聘原则，结合初审情况进行人员筛选。

（四）评审。主任办公会对复审合格人员进行评审，形成拟聘名单。

（五）审定。本会委员会会议对拟聘名单进行审定。

（六）聘任。向受聘仲裁员发放聘书，列入重庆仲裁委仲裁员推荐名册。

II. Recruitment Procedures

1. Application. The applicant shall fill in the Application Form for Arbitrators of Chongqing Arbitration Commission (see the annexes, or download it from “International Arbitrator Open Recruitment Column” on the homepage of Chongqing Arbitration Commission website at www.cqac.org.cn), and submit the Application Form and relevant materials in accordance with the List of Materials for Arbitrator Applicants.

2. Preliminary review. Conduct preliminary review of all application materials (including application time, qualifications, personal information, etc.).

3. Re-examination. According to the principle of selecting based on merit, select suitable candidates based on the preliminary review results.

4. Review. The director’s office meeting will review the candidates and form a list of proposed recruiting arbitrators.

5. Approval. The Committee Meeting of the Commission will verify and approve the recruitment list.

6. Appointment. Issue appointment letter to the arbitrators and include them in the arbitrator recommendation list of Chongqing Arbitration Commission.

三、注意事项

（一）申请时间自公告发布之日起至2024年8月20日止，逾期不再接收申请。

（二）申请人须同时提交电子版及纸质版申请材料，并确保其真实、准确、完整。

电子版申请材料发送至：cqaciac@cqac.org.cn，邮件及文件名称注明“仲裁员申请+姓名+经常居住地”。所提交的全部材料均应扫描为PDF格式后，全部压缩打包完整发送。

纸质版申请材料邮寄至：重庆市渝北区星光大道96号土星B2栋104室（重庆仲裁委员会收），邮单内件注明“仲裁员申请+姓名+经常居住地”。

（三）是否决定聘任为仲裁员，以发放仲裁员聘书为准，聘任后列入仲裁员名册。如申请人未被聘任，不再专门予以回复。

（四）申请人提供的申请材料，本会将严格保密。纸质版申请材料、电子版申请材料不予退回。

（五）本次公开选聘名额控制在40名以内。

III. Notes

1. The application starts from the announcement of the publication to August 20, 2024, application after the deadline will not be accepted.

2. The applicant shall simultaneously submit true, accurate and complete application materials, in electronic and paper versions.

Please send the electronic materials to cqaciac@cqac.org.cn, with the email and file name uniformly labeled “Arbitrator application + name + habitual residence”. Ensure all the materials are scanned into PDF, compressed, packaged and sent completely.

Please mail the paper version to Room 104, Saturn Building B2, 96 Starlight Avenue, Yubei District, Chongqing, China (Recipient: Chongqing Arbitration Commission), marking with “Arbitrator application + name + habitual residence” inside the mail (Note: whether paper version is needed or not).

3. Appointment shall be subject to the issuance of appointment letter, and the arbitrator will be included in the arbitrator list after appointment. No reply will be made to the applicants if they have not been appointed.

4. The Commission will keep the application materials strictly confidential. Electronic and paper materials will not be returned.

5. The recruitment quota is 40.
