    1.中国重庆两江国际仲裁中心
    中国重庆两江国际仲裁中心是目前中国西部地区首家专业解决涉外及国际商事争议的国际仲裁机构。中心隶属于重庆仲裁委员会,独立办理国际、涉外,以及涉及香港特别行政区、澳门特别行政区或者台湾地区的商事仲裁案件,并提供咨询、立案和开庭审理等仲裁服务。

  独立公正的仲裁机制。中心引入国际商事仲裁先进制度,独立运作;建立了国际化、专业化、现代化的仲裁服务机制。中心办理案件不受其他单位或者个人的干预,独立行使仲裁权,以确保仲裁活动的公平公正、高效便捷、保密廉洁。
  国际化的仲裁规则。中心仲裁规则参考了《联合国国际贸易法委员会国际商事仲裁示范法》,以《联合国国际贸易法委员会仲裁规则》为蓝本,最大限度地吸纳了国际仲裁惯例,引入了包括临时措施、合并仲裁等先进程序规定,体现出高度的国际化。

  尊重当事人的意思自治。中心充分尊重当事人的自主选择权,当事人可以选择本中心仲裁员名册和其他仲裁机构仲裁员名册内的仲裁员;当事人协商一致可以选择仲裁规则,仲裁适用的法律、语言、证据规则、开庭地点、仲裁庭组成方式等符合自己特殊需要的仲裁程序,充分运用现代仲裁程序的灵活性和便捷性,促进争议解决。
  仲裁裁决执行范围广泛。中国为1958年联合国《承认及执行外国仲裁裁决公约》缔约国,目前该公约缔约国已达156个,几乎覆盖所有国际商事活动相对活跃的国家,中心作出的裁决可依照公约规定在上述国家得到承认和执行。
  相对低廉的仲裁成本。中心按照国际惯例确定了可供当事人选择的多种收费方式,相对其他国际和国内仲裁机构更为灵活,费用更加低廉。并且由于仲裁一裁终局、程序便捷等特点,使得当事人选择仲裁解决争议相对诉讼而言更为经济。

    如果您想通过仲裁解决纠纷,请在合同中约定由本中心解决争议的有效仲裁条款。为此,特向您推荐如下仲裁示范条款:
    “凡因本合同引起的或者与本合同有关的任何争议,均提交中国重庆两江国际仲裁中心按照其仲裁规则进行仲裁。仲裁裁决是终局的,对双方均有约束力。”
 

A. WHY CHONGQING?

Chongqing is the only municipality directly under the Central Government in Central and Western China, a major central city and an economic center at the upper reaches of the Yangtze River. Chongqing has unique geographic advantages. It is located at the tie point of the Belt and Road and the “Y” formed pathway of Yangtze River Economic Zone, connecting China's vast west to eastern coast, linking the south with the north. The construction of its “Opening-up Highland of Inland Areas” is accelerating, and 3 national first-class ports and 3 bonded supervision areas have been established. Meanwhile, the foreign trade in Chongqing is being further promoted by the Yangtze River Golden Waterway and the Yuxin‘ou (Chongqing-Xinjiang-Europe) International Railway. The economic growth in Chongqing is robust, with the GDP increasing by double-digit for three consecutive years. In 2015, the local GDP reached RMB 1.57trillion, representing a 11% increase from 2014, which was the fastest growing in China.

Chongqing has a good legal environment, a reliable social governance system and a well-established alternative dispute resolution system including the impartial arbitration mechanism and the flexible mediation mechanism. The Chongqing Municipal Government fully supports the development of arbitration and courts in Chongqing are pro-arbitration. Chongqing is a large pool of legal talents, with experts, scholars, lawyers, arbitrators and mediators experienced both in academia and practical circles, who are able to provide high-quality legal services for parties in multilanguage.

Chongqing is the only transportation hub combining water, land, and air transportation in Western China. Expressways and railways radiate in all directions. Chongqing Airport has opened 83 domestic air routes and 58 international air routes, which covered the areas of Europe, America, Australia, Asia and so on, with more than 32 million passengers passing through each year. Citizens from 45 countries can apply for the 72-hour Transit Visa Exemption.

 

B. WHY China Chongqing Liangjiang International Arbitration Center(LJIAC)

LJIAC is the first international arbitration institution that resolves foreign-related and international commercial disputes in Western China. LJIAC is affiliated with the Chongqing Arbitration Commission, handling foreign-related, international, Hong Kong, Macao and Taiwan-related commercial dispute cases independently.

1. Independence and Impartiality

LJIAC adopts the advanced international commercial arbitration systems, operating independently, and provides international, professional and state-of-the-art arbitration services.

LJIAC exercises arbitration power independently, free from intervention of any other organization or individual in handling cases, to ensure the independence, impartiality, efficiency and confidentiality of arbitration.

2. State-of-the-Art Rules

The Rules are established by reference to UNCITRAL Model Law on International Commercial Arbitration, UNCITRAL Arbitration Rules and international arbitration practice, introducing advanced arbitration procedures such as interim measures and consolidation of arbitrations.

3. Professional Team

     The arbitrators of LJIAC are senior experts and scholars with proficient legal expertise, good morality and first-class professionalism in fields such as international law, international trade, investment, and maritime matters. The Secretariat members of LJIAC all graduate from prestigious universities both from China and abroad, with solid legal knowledge and excellent comprehensive quality, and are also proficient in multiple foreign languages, thus can provide efficient and quality services to clients from various countries and regions.

4. Party Autonomy

LJIAC fully respects party autonomy. Parties may select arbitrators from the Panel of Arbitrators of LJIAC or of any other arbitration institutions. Parties may also agree on the applicable arbitration rules, applicable laws, languages, rules of evidence, place of hearing, the formation of the tribunal and any other arbitration procedures meeting the specific needs of the parties.

5. Enforceability

China is a contracting party of the Convention on Recognition and Enforcement of Foreign Arbitral Awards of 1958(the New York Convention”), signed by 156 jurisdictions that almost cover all the countries and areas with relatively active international commercial activities. Thus arbitral awards made by LJIAC could be recognized and enforced in accordance with New York Convention in these jurisdictions.

6. Time and Cost-efficiency

LJIAC provides parties with a variety of payment methods, with fees and costs lower than other international and domestic arbitration institutions. Due to the flexibility and finality of arbitration proceedings, resolving disputes through arbitration may often be quicker and cheaper than resolution through court litigation.

If you would like to seek arbitration to settle disputes, please remember to include a valid arbitration clause in the contract. We recommend to you the following Model Clause:

Any dispute arising from or in connection with this Contract shall be submitted to China Chongqing Liangjiang International Arbitration Center for arbitration which shall be conducted in accordance with the Center’s arbitration rules.
